This Ministerial Decree establishes the categories of payers of environmental fees, the modalities of calculation thereof, and also the types of environmental pollution requiring compensation. Compensation in the form of payment of environmental fees shall be required for standard and above permitted standard emissions and discharge of pollutants into environment and waste disposal, including: (a) emissions into the atmospheric air from stationary and non-stationary sources; (b) effluent waste water discharge into waterbodies and soil; and (c) toxic and non-toxic waste disposal. Environmental fees shall not be applicable to: (a) out of balance ores considered raw material resources; (b) industrial waste temporarily stored (up to six months) and subsequently used for recycling; (c) purified waste water used for irrigation; (d) mine dump; and (e) limited emissions, discharge of pollutants and waste disposal for which calculated annual environmental fees do not exceed five minimum monthly wages.
