Drainage (Jersey) Law 2005 (No. L. 3 of 2005).

This Law provides with respect to administration and operation sewerage systems, control of effluent wastewater and flood defence works. It appoints the Environment and Public Services Committee as the sewerage undertaker and flood defence authority for Jersey in respect and defines its functions with respect to sewerage and flood defence. No person shall construct waterworks for discharging foul sewage or surface water on to the sea shore or into the sea without the consent of the Committee. Any person who causes or knowingly permits surface water to be discharged on to the sea shore or into the sea, otherwise than through an authorized sewer, drain or outfall shall be guilty of an offence. the Committee may adopt sewers, sewage disposal works or outfalls and may reserve a public sewer for foul sewage only or for surface water only. The Law provides rules for connection to and use of public sewers. It also provides rules for the discharge of effluent wastewater from business premises. Discharge requires a trade effluent discharge consent. The Committee may by Order designate any watercourse or flood defence works as being a facility of general significance for the purposes of flood defence. Alteration of flood defences requires the consent of the Commission. Remedial action shall be undertaken by person causing damage or by the Committee.
