This Act provides the requirements for fertilizers and the handling thereof in order to ensure that fertilizers do not pose a threat to human and animal life and health or to property or the environment and that fertilizers have a favourable effect on plants and plant produce. The following are excluded from the scope of this Act: (a) unprocessed organic fertilizers; (b) unprocessed natural fertilizers; and (c) waste water sludge and compost made therefrom. A legal person, sole proprietor or state or local government authority may be a handler of fertilizers. A fertilizer shall: (a) not pose a threat to human and animal life and health or to property or the environment, if used as required; (b) comply with the requirements established for the composition of fertilizers; (c) be labelled according to the requirements; and (d) be registered in the register of fertilizers, except fertilizers with EC FERTILIZER" markings. The requirements for the composition of fertilizers by fertilizer type shall be established by the Minister of Agriculture. The distributor of a fertilizer shall produce the document attesting the conformity of the composition of the fertilizer or a copy thereof for the buyer of the fertilizer
