Ministerial Decision No. 118 of 2004 issuing a Regulation for controlling air pollutants released from stationary sources.

This Ministerial Decision is composed of 3 articles, an attached Regulation and an Annex. Article 1 specifies the rules and regulations for controlling air pollutants released from stationary sources. These cancel those issued under Ministerial Decision No. 5 of 1986 (art. 2). Article 2 of the attached Regulation requires the owner to use scientific means to prevent direct or indirect emissions of toxic and hazardous gases and particulates from a site, and to treat such gases and particulates appropriately to render them harmless and to comply with the Ministry’s standards as specified in the attached Annex. The owner must also monitor the particulate and gas emissions from time to time, carry out any necessary alterations to the stacks or the sources of generation, and report the results of emission monitoring to the Ministry (art. 3). In case of any potential risk to human health or odor/noise nuisance caused by air emissions released from a work site, the Ministry shall specify the necessary mitigation measures to be undertaken by the owner (art. 4). Article 5 bans emissions of dark smoke from the chimney of any building, industrial/commercial premises, or any other site. Open burning of organic or agricultural wastes is also prohibited. The owner is required to apply for an environmental permit. No construction or operation can start before the Ministry approves the height of the chimney which shall be sufficient to prevent smoke, grit, dust and gases emitted from the chimney causing injury to health or nuisance. Minimum stack heights (from ground level) are given for different kinds of installation (art. 6). Article 7 outlines the duration and fees of permits. Emission standards are given in the Annex.
