The aim of this Act is to regulate the production, importation and handling of fertilizers, nutrients and soil amendments in the GCC. The provisions of this Law are applicable to both chemical and organic fertilizers. The present Act is composed of 15 articles. Article 1 deals with the objective of this Act. Article 2 provides for terms and definitions. Article 3 classifies the fertilizers subject to this Act. Article 4 entrusts the Minister of Agriculture to issue the requirements for allowed fertilizers, nutrients and soil amendments. Articles 5 and 6 entrust the Competent Authority to register fertilizers, nutrients and soil amendments as well as define fees. Article 7 states that a permit is requested to import fertilizers, nutrients and soil amendments and gives the exceptions. Article 8 requires a plant health certificate (issued in the country of origin) to accompany each shipment entering the State proving that they are free from weed seeds and harmful microorganisms (fungi, viruses, nematodes…) as well as harmful animal and insect pests. A certificate indicating that they are free from heavy metals and radioactive elements is also required. Article 10 deals with inspections. Article 11 contains offences and penalties. Articles 12-15 deal with general provisions: the Minister of Agriculture shall issue the implementing Regulations of this Order; any amendment to this Order must be agreed by Member States and shall not be valid or effective unless its approval by the Supreme Council.
