These Regulations have been adopted by the Minister on the basis of particular provisions laid down in Environmental Quality Act 1974, namely Sections 21, 45 and 51. Section 21 entrusts to the Minister the power to specify conditions on discharge, whereas Section 45 regards compounding of offences. These Regulations pursue the control of emission from diesel engines. They are divided into the following Parts: (I) Preliminary; (II) Control of diesel engine on motor vehicle; (III) Smoke emission control of motor vehicle; (IV) Requirements of smoke test; (V) Licence for contravention of acceptable conditions; (VI) Offences.; As prescribed by regulation 4, no person shall install or replace the engine system of a motor vehicle with a diesel engine which emits pollutants exceeding the standards established in the First Schedule hereto. Further provisions concern the maximum concentration of smoke and maximum density of smoke which is permitted (Regulations 10 and 11). Regulation 20 indicates the circumstances under which a special licence may be granted to contravene the conditions laid down in these Regulations. Regulation 21 deals with offences. The following eight schedules are attached: (I) Emission standards of pollutants; (II) Emission standards of pollutants for new models of motor vehicles on or after 1 January 1997; (III) Ringelmann Smoke Chart; (IV) Observation procedure; (V) Free acceleration test; (VI) Motor vehicle smoke emission test certificate; (VII) Prohibition order; (VIII) Fees payable.
