The present Supreme Decree approves the Regulation for the Reuse of the sludge generated in the Wastewater Treatment Plants, which aims to establish the provisions to determine the characteristics of the sludge; as well as the classification, the parameters for the production and the control of the application of the biosolids coming from the stabilization of sludge generated in the wastewater treatment plants (WWTP), domestic or municipal. The purpose of this Regulation is to promote the reuse of the sludge generated in the WWTP, which after being transformed into biosolids, can be used in agricultural, forestry, ceramic industry activities, among others, considering the risks to health and the environment . The sanitation service providers are authorized to market biosolids from the stabilization of sludge generated in the WWTP for the purpose of reuse in favor of third parties, with the corresponding consideration, provided that there is prior agreement between the actors. For the commercialization of biosolids, the producer must inform the Directorate General of Environmental Affairs (DGAA) of the Ministry of Housing, Construction and Sanitation, at each opportunity that this activity performs, the concentration of the total nitrogen parameter in the biosolids. If this is not complied with, the byproduct can not be reused as a Class A or Class B biosolids. The National Registry for Production and Reuse of Biosolids is created, which is in charge of the DGAA of the Ministry of Housing, Construction and Sanitation. The agents involved with the production and commercialization of biosolids are obliged to register in the National Registry of Production and Reuse of Biosolids, prior to commercialization. The administrative procedure applicable to the registration of the producer is subject to negative administrative silence. The registration of the producers of biosolids in the National Registry of Production and Reuse of Biosolids is an administrative procedure of prior evaluation.
