This Act establishes the National Solid Waste Management Authority, makes provision for the management of solid waste by the Authority and related matters, provides rules for the recycling of waste and prescribes offences.; The National Solid Waste Management Authority, established as a body corporate, shall be responsible for the collection and disposal of solid waste in Jamaica and shall advise the Minister on solid waste policies. “Solid waste” includes hazardous waste and waste from agriculture. The Authority may appoint inspectors for purposes of this Act and shall be responsible for the licensing of persons that operate a solid waste facility, collect solid waste or otherwise manage solid waste. In considering an application for a licence, the Authority shall seek recommendations from other environmental agencies such as the Natural Resources Conservation Authority or the Water Resources Authority. The Authority may issue a Cessation Order in respect of illegal solid waste management operations. The Act grants other powers to the Authority to control, in collaboration with the Natural Resources Conservation Authority, solid waste collection and disposal operations. Appeal against decisions of the Authority may be had with the Appeal Tribunal established for this purpose by this Act.
